Can I make changes to an existing exclusivity agreement?
No, once an exclusivity agreement is in place, it can’t be edited by the brand or the retailer. If you need to update an agreement, we recommend cancelling the agreement using the steps below and asking the retailer to create a new agreement with the updates applied.
Can Faire cancel an exclusivity agreement?
Yes, Faire will cancel an agreement after the first 30 days if the retailer has not placed any orders or indicated any interest in keeping the agreement active. Faire will notify the retailer that they need to place an order within the first 30 days of activating the agreement or recommit to the agreement in order to keep it active. If the retailer does not take the necessary actions to keep the agreement active, Faire will cancel the agreement after the first 30 days and you’ll be able to sell to other retailers in the area.
Can I cancel an exclusivity agreement?
Yes, if you need to cancel an exclusivity agreement, you can do so through your portal for 30 days after the agreement is activated. To cancel an agreement in your portal, please follow these steps here.
After the first 30 days, you’re still able to cancel an agreement in your portal if the retailer is pacing behind their required annual spend. A retailer is considered to be pacing behind on their exclusivity agreement if the total they’ve spent so far is meaningfully less than what we would expect at this point in the agreement.
If the retailer is on track with their spending and you need to cancel the agreement for any reason, we encourage you to first reach out to the retailer via Faire Messenger to discuss canceling the agreement. Can a retailer cancel our exclusivity agreement?
Yes, retailers can cancel an agreement in their portal within 30 days of activating it. If it has been more than 30 days since the exclusivity agreement has started, it is Faire’s expectation that both parties abide by the agreement they chose to enter. However, in some extenuating circumstances (ex: the retailer goes out of business or faces a natural disaster), the retailer may request Faire end the agreement early.
Can Faire settle an exclusivity agreement early?
Faire will monitor all exclusivity agreements and may settle them early if the retailer is lagging behind significantly on the required annual spend or if they have issues with their account. In such cases, Faire will notify the retailer about settling the agreement early and give them the option to recommit to keep the original end date. If they do not recommit, Faire will settle the agreement early with a prorated required spend.
If Faire is unable to charge the retailer this prorated amount at the new agreement end date, Faire will pay you out your earnings provided you have fulfilled your obligations under the agreement.
This payout is calculated as the prorated remaining amount less Faire’s commission and processing fee, and less an estimate of the cost of goods you would have shipped. Our goal with this payout is to match your earnings had the agreements been on track (i.e. the retailer placed orders and you shipped them products). The retailer will no longer have exclusivity with you in their local area.
How do I cancel an exclusivity agreement?
To cancel an exclusivity agreement through your portal within the first 30 days or if a retailer is significantly pacing behind, please follow these steps:
- Select Exclusivity from under the Customers tab on the left side of your portal.
- Choose the retailer’s shop name from the Agreements section.
- Scroll until you see the retailer’s Exclusivity details on the right side of the page.
- Select Cancel agreement.
- On the modal that opens, select a cancellation reason and select Next.
- Include a cancelation note and select Next. The agreement will be canceled.
What if I need to cancel an exclusivity agreement that’s more than 30 days old?
You can cancel an exclusivity agreement that began more than 30 days ago in your portal if the retailer is significantly pacing behind their required annual spend. To cancel an agreement in your portal, follow the steps here.
If the retailer is on track with their required annual spend and you still want to cancel the agreement:
- Reach out to the retailer through the Messages tab in your portal.
- Discuss the situation with the retailer and ask if they agree to cancel.
- Once you’ve reached an agreement with the retailer, let us know you’ve completed these steps and we’ll connect you with a specialist to help with your cancellation request.
