Exclusivity is a program that allows you to be the only Faire stockist of a brand's products in your local area in exchange for an annual spend commitment with the brand.
The exclusivity program is available to all brands on Faire. However, please note that only brick & mortar retailers will be eligible to participate in the program. Online only retailers are not eligible to participate in the exclusivity program.
How does exclusivity work?
There are two ways you can activate exclusivity with a brand on Faire:
- Custom exclusivity requests: You can send any brand a custom exclusivity request with an annual spend offer. This is the amount you are committing to spend in a year to get exclusivity for 12 months. The brand will have 30 days to accept, decline, or suggest an alternative annual spend.
- Instant Exclusivity: If a brand is offering Instant Exclusivity, you can activate an agreement right away by committing to their required annual spend. The agreement will start as soon as you activate.
All exclusivity agreements are for 12 months and cover the brand’s entire catalog. All orders placed within the 12 month period will count towards your spend commitment.
Should there be a remaining balance at the end of the 12 month period, Faire will charge you for the remaining balance. You will get a credit with the brand for 60 days to place orders. Learn more. Please note, Faire is not responsible if you don't meet the required annual spend.

How can I set up a custom exclusivity agreement?
To request custom exclusivity with a brand on Faire follow these steps:
- Navigate to the brand’s page and click the banner that reads Exclusivity is available in your area.
- You’ll be taken to the brand’s exclusivity page where you’ll select the required annual spend that you’re willing to commit to spending within 12 months in exchange for exclusivity.
- Add a note telling the brand why you’d like exclusivity with them.
- Check the box acknowledging the program terms.
- Send the request. The brand will have 30 days to review your request and accept, decline, or counter offer.
How can I set up an instant exclusivity agreement?
To activate instant exclusivity with a brand on Faire, follow these steps:
- Navigate to the brand’s page and click the banner that reads Exclusivity is available in your area.
- You’ll be taken to the brand’s exclusivity page where you’ll see the required annual spend set by the brand.
- Check the box to commit to the brand’s required spend over the next 12 months.
- Activate exclusivity. The brand will have 30 days to review and may cancel if needed. If the agreement is not a good fit, the brand will provide a reason for the cancellation. You can also cancel within 30 days of activation without any penalty.
If the brand’s required annual spend doesn’t work for you, you can send a custom request with a different annual spend offer instead!
What is my exclusivity area?
Your default exclusivity area is determined by Faire, based on your location and the density of other retailers nearby. It typically ranges between approximately 0.3-5.5 miles (0.5-9 km) and captures roughly 20 nearby retailers. You can view your exclusivity area on the Exclusivity landing page.
If your store address is incorrect, you can change it via the Settings in your Faire portal. Go to the Stores tab of your Settings, select Edit next to your store, continue to Store address, and then update your address.

During your exclusivity period, no other retailer in your exclusivity area will be able to buy from the brand on Faire. Retailers who are blocked from ordering will still be able to view the brand’s page and products, but will not be able to add products to their cart.
Which orders count towards my exclusivity agreement?
After the exclusivity agreement is activated, every order that you place with the brand on Faire will count towards the required annual spend. Orders placed prior to activation or outside Faire will not count towards the required annual spend.
What if I don't meet the required annual spend?
At the end of the 12 month period, you’ll be responsible for any unmet required annual spend. If you haven’t met the required annual spend:
- The remaining balance for the agreement will be automatically charged to your default payment method on the agreement end date. We’ll notify you about the charge via email as well as in your portal, and you’ll be able to view your invoice for the charge on your Exclusivity page
- You'll then see credit in your account for the charged amount for you to spend with the respective brand within 60 days. This credit will automatically apply to your orders with the brand within the 60 day timeframe. During these 60 days, other retailers in your area will be able to order from the brand but will not be able to activate exclusivity until you have used up your credit or until after the 60 days
- After 60 days, any unspent credit will expire and we will pay the brand the remaining amount in order to meet the agreed required annual spend and other retailers will be able to activate exclusivity with that brand
While the brand is required to ship you products for orders you place with this credit, the products must be ordered within 60 days of the agreement end date for the requirement to apply.
You can keep track of your remaining required annual spend per active exclusivity agreement from the Exclusivity page. We will send reminders to you throughout the 12 months to share your progress toward your spending commitment(s).
Where can I find my active exclusivity agreements?
- Go to your account dropdown menu and select Exclusivity. Here you should see a table with all your active exclusivity agreements
- Select a brand from the table to see more details about each agreement, including the exclusivity area for a specific agreement
Can I cancel an exclusivity agreement?
If you are within 30 days of activating an exclusivity agreement, you can cancel the agreement in your portal. After 30 days, it is Faire's expectation that both parties abide by the terms of the agreement. However, in the rare case that an extenuating circumstance arises (ex. you go out of business or are faced with a natural disaster), you may reach out to Faire to ask to end the agreement early. Faire will work with you and the brand to reach a fair settlement based on the terms of your agreement, ensuring fairness to both parties.
To cancel an agreement in your portal within the first 30 days, please follow these steps:
- Navigate to your account dropdown and select Exclusivity. This will lead you to your Exclusivity page.
- Select the brand’s name from the Active agreements table and a pop-up modal will open with the details of the agreement.
- At the bottom of the modal, select Cancel agreement.
- Include a cancellation reason and select Cancel exclusivity agreement. The agreement will be canceled.
Can Faire cancel an exclusivity agreement?
Faire will cancel an exclusivity agreement after the first 30 days if you have not placed any orders with the brand under the agreement. Faire will send you reminders to keep the agreement active by placing an order or recommitting to the brand’s required spend during the first 30 days of the agreement. If no action is taken, the agreement will automatically be cancelled after 30 days.
Can Faire settle an exclusivity agreement early?
Faire may settle your agreement with a brand any time after the first 30 days of the agreement activation date if you are lagging behind significantly on your required annual spend or if there are issues with your account. In such cases, Faire will notify you about settling your agreement early and give you the option to recommit to keep the original end date. If you do not recommit, Faire will settle the agreement early with a prorated required spend.
Note that you are still responsible for meeting the prorated required spend. Faire will charge you for any remaining balance and give you a credit you can use with the brand for 60 days following the end of the agreement.
Can I change my exclusivity area?
If you believe that the exclusivity area we have predetermined for you does not accurately reflect your shopping district, you can update it before you activate an exclusivity agreement with a brand.
To update your exclusivity area via the main exclusivity page:
- Navigate to your account dropdown and select Exclusivity
- Scroll down and locate the Explore your personalized exclusivity area section
- In the map, find your business name and address and select Edit area. You’ll be taken to a pop-up to edit your exclusivity information
- In the Set exclusivity area section, set your desired exclusivity area radius using the slider. Note that you cannot choose an area larger than your zip code or postal code area.
- Select Save
Please note, larger areas will increase the likelihood of a brand rejecting your exclusivity agreement. Please work with the brand to find an exclusivity area that will work for both of you.
Additionally, only exclusivity agreements activated after updating your exclusivity area will use the new area size. Any previous agreements will continue to use the area size from when they were activated.
Can I update my exclusivity agreement address?
Once an agreement is created, we cannot change the exclusivity address since another customer for the brand may be located there. If your address is wrong, we recommend updating your address on your account, and contacting the brand to cancel your current agreement. Faire’s support team can then help to create a new agreement with the correct address, and backdate the agreement start date so that your previous orders will still count towards the new agreement.

How can I find out which brands are offering exclusivity?
Since exclusivity is a request-based program, all brands on Faire are offering exclusivity by default. However, exclusivity may not be available with a specific brand if they’ve opted out of the program or if they’re already offering exclusivity to another retailer in your local area.
To determine whether exclusivity is available with a brand, navigate to the brand’s page and look for an orange banner that says Exclusivity is available in your area.
I have multiple locations, can I have exclusivity for all locations?
Exclusivity agreements are currently between a brand and a single store location. If you have multiple store locations and have added them to your Faire account, exclusivity will only apply to the default store you signed up with. Exclusivity will not apply to each store you have added.
How can I track my progress towards my exclusivity agreement?
You can track your agreement on the brand’s page or through the Active agreements table on the Exclusivity page. Both will show you all the exclusivity details, including your remaining required spend, the expiration date, and a map of your exclusivity area. Faire will also send you periodic reminders throughout your 12-month exclusivity period to help you stay on track with your required spend.
What happens if another retailer in my area has exclusivity with a brand I want to buy from?
If another retailer in your area has an active agreement with a brand you want to buy from, you can still browse the brand’s page and save products but you cannot add products to your cart or place an order due to the active exclusivity agreement. If you try to add a product to your cart, you will receive an error message that says A retailer in your area currently has exclusivity with this brand.
If you order different products than the exclusive retailer in your area, you can reach out to the brand to request to be marked as exclusive or set up an exclusivity agreement to get unblocked and continue ordering.
What if the brand isn't honoring my exclusivity agreement?
If you find out that a brand isn’t honoring your exclusivity agreement, please contact our Customer Support team. Keep in mind, other retailers on Faire may have previously ordered from a brand and may have inventory from before the start of your exclusivity agreement. These retailers will still carry the brand until the product sells out, but they won’t be able to place any orders after the date your exclusivity was activated.
Can I still order from a brand without having exclusivity?
Yes. Exclusivity is separate from ordering, which means you can continue ordering from your favorite brands without securing exclusivity with them.
However, keep in mind that if another retailer within your local area activates an exclusivity agreement with one of your brands, you may be blocked from ordering from that brand for the duration of their exclusivity agreement. Brands are encouraged to review all of their current stockists before moving forward with an agreement to ensure they’re able to honor the agreement.
Does the required annual spend I agree to for exclusivity replace the brand's order minimum?
No, the required annual spend is only for the offer of exclusivity. To order from a brand, you will still need to meet the brand’s order minimum as has always been the case.
If you choose to activate an exclusivity agreement with a brand, it is at that point that you’ll make an annual spend commitment. Every order that you place over the 12 month period will count towards your spend commitment.
What happens at the end of an exclusivity agreement?
This depends on whether or not you have met the required annual spend.
- If you have met the required annual spend, congratulations you have successfully completed your exclusivity agreement

- We recommend you renew agreement for the next 12 months, otherwise retailers in your area will be eligible to buy from this brand

Can I renew my exclusivity agreement with a brand?
You can renew an agreement up to 3 months before the current one expires provided you have met the minimum spend requirement of the current agreement. The brand has 30 days from the start of the new agreement to cancel if they cannot commit to it.
To renew an agreement, please follow these steps:
- Navigate to the brand page of the brand you want to renew your agreement with. If you have met your required annual spend and the agreement is within 3 months from ending, you will see a renewal banner.
- On the renewal banner at the top of the brand’s page, select Renew agreement. A new exclusivity renewal page will open.
- On the renewal page, select Next. An agreement activation pop-up modal will open.
- In the pop-up modal that opens, type in your name and select Activate agreement. Your agreement will be renewed.
