We're piloting topical CBD products with select brands on Faire, with the potential to expand to additional brands in the future. Topical products are applied to the body but not ingested.
What types of CBD products are not allowed on Faire?
Faire does not allow:
- Ingestible CBD products
- Inhalable CBD products
- Products with synthetic / delta-8 THC
- Products with >0.3% THC
- CBD products marketed or intended to have an intoxicating effect
- CBD products that make health or dietary claims, such as treating anxiety or pain, or labeling claiming to be a dietary supplement, herbal supplement, or other such term that is prohibited by the FDA for CBD products.
- CBD products that could be interpreted by regulators as marketing to children.
Can I find topical CBD products on Faire?
Topical CBD products are available for purchase to all of our US retailers so long as they do not contain synthetic / delta-8 THC or have >0.3% THC. However, because Alaska and Idaho prohibit topical products with any detectable levels of THC, only topical CBD products with 0.0% THC are permitted to be listed to retailers in those states.
Please note that retailers are responsible for complying with all laws and regulations in their operating states. Your state may require registration or license to purchase or sell CBD products. It is your responsibility to obtain and maintain this registration. Your state may also have age restrictions (either 18+ or 21+) for retailer sale of CBD products. If you're unsure about your state's requirements, we recommend consulting legal counsel.
Can I find ingestible CBD products on Faire?
Faire is not able to support the listing of ingestible CBD products on the marketplace at this time.
Laws and regulations to be aware of when selling CBD products
It is your responsibility to research the laws and regulations that apply in the location where you sell your products. CBD laws and regulations are changing rapidly. Faire cannot provide legal advice. In general, many states restrict CBD sales to persons above the age of 18 or 21. Some states require retailers to obtain a hemp product retailers license or registration, and purchase only from brands with similar licenses or registrations. Various states may also limit the amount of THC in CBD products below the federal limit of 0.3% by dry weight, such as Alaska and Idaho which both prohibit any detectable level of THC in CBD products (even topical products). Retailers should ask brands to provide a certificate of analysis (COA) for the products they plan to purchase, and after reviewing the COA to confirm cannabinoid amounts are within legal levels, keep the COA on file.
Do I need to be registered or licensed to be able to purchase CBD products?
Your state may require you to be registered or obtain a license to purchase CBD products to sell at retail. It is your responsibility to determine if you need a registration or license in your location, and if so, ensure this registration or license is obtained and kept up-to-date. If you're unsure whether your state has this requirement, we recommend consulting legal counsel to confirm.
What is Faire’s vetting process for CBD products?
Faire follows federal and state-specific regulations to help ensure that compliant CBD products are sold on the platform. We take the following precautions to vet the CBD products on our platform:
- Regulatory Compliance: Brands must affirm that they ensure their business, operations, and CBD products comply with all laws and regulations in their operating states—including states where they plan to sell.
- Certificate of Analysis (COA) Requirement: Brands must submit at least one COA covering their entire CBD catalog.

Marketing and Labeling Restrictions: Faire prohibits products, packaging, or descriptions that:
- Make health or dietary claims
- Could be interpreted by regulators as marketing to children
- Prohibited Products: The following types of CBD products are not allowed on Faire:
- Ingestible CBD products
- Inhalable CBD products
- Products containing synthetic cannabinoids or delta-8 THC
- Products with more than 0.3% THC
- Any CBD product that is marketed or intended to have an intoxicating effect
Note that although Faire conducts compliance checks, Retailers cannot rely on Faire for legal diligence and instead are responsible for ensuring their business and the products they purchase comply with all laws and regulations in the states they operate in.
Can I return CBD products?
At this time CBD products are not eligible for return on Faire.
